Contract Negotiations

ACA – Qld / NT invites members to participate in a lunchtime presentation with a panel addressing contract negotiations.

Panellists will review two or three of your contracts and outcomes. They will then workshop clauses and seek discussion from the audience as to their wins. The clause outcomes will be minuted and shared, thus broadening a common understanding of what can be achieved.

The top five issues to be discussed include:

  • Fit for purpose
  • IP
  • Novation

The Panel

Justin O’Neill

Justin formed O’Neill Architecture in 2009, following 17 years as Founding Director of Arkhefield. O’Neill Architecture is structured as a small practice with a large practice approach to systems, research and thinking. The practice is currently working on a range of waterfront, aged care, retirement, residential and retail projects throughout Queensland. Justin has been the recipient of over 60 architectural awards, was AIA State Awards Director in 2009 and Chair of the Brisbane Powerhouse from 2011-2016.

Louise Cutler

As a director at Phillips Smith Conwell, Louise leads the Healthcare team. Over many years she has worked across a range of major projects through all stages of the design and delivery process. These have been delivered under a variety of procurement methods for both private and institutional clients. Acting as Architect and Superintendent, Louise consistently manages multiple stakeholders and successfully delivers high quality spaces within program and budget constraints. Louise maintains the view that contracts should be reasonable. She will share her approach to some of the contract clauses currently on her desk.

Philip Pawsey

Philip is a chartered management accountant with significant experience in the architectural services sector. Since moving to Brisbane in 2007, he has worked primarily in creative industries, including nine years as General Manager of Arkhefield, and is now a consultant within the professional services space. He has managed significant contracts with state utility companies, national builders and developers with projects ranging in scale from private residential homes to the Gold Coast Commonwealth Games Atheletes’ Village. His experience has included contract review and managing expectations, establishing terms, negotiation of clauses and dispute resolution including engaging lawyers in project litigation. Prior to working in Australia, Philip spent 15 years working in Europe and the US in commercial roles within larger corporates. While working in S.C. Johnson’s iconic Frank Lloyd Wright designed office buildings in the early 90’s that he developed his keen interest in architecture and design.
