Casual Employment Agreement

29 October 2021 - Updated: 23 May 2022

The ACA has produced an updated Casual Employment Agreement Template to support members. The updated version includes four separate versions of Schedule A specific to relevant Awards.

This template casual employment agreement can be used and adapted for employees covered by the following awards:

  • Architects Award 2020;
  • Clerks – Private Sector Award 2020;
  • Manufacturing and Associated Industries and Occupations Award 2020; and
  • Miscellaneous Award 2020

The terms specific to each award are contained in Schedule A to the contract.

There are four separate versions of Schedule A specific to an award. Members will need to determine appropriate award coverage and delete the schedules, which do not apply to the employee in question. Should you need assistance in determining which Award applies or how to use the contract, you should seek legal advice, or submit an inquiry through the ACA Industrial Relations Advisory Service.

Member practices should review and adjust the contract to suit their particular practice and in relation to any relevant state-based industrial laws. ACA recommends that you seek legal advice before amending the template contract as any change you make may have unintended consequences.

The laws relating to casual employment have recently changed and it is important to keep up to date with these changes to ensure you are complying with your legal obligations. For detailed analysis of employer obligations relating to casual engagement, see the article from Tom Earls from Fair Work Lawyers.

Employment Agreements are an ACA member resource, and are only available to members. Members should log in to download the template below.
