Fair Work Amendment Bill

On 27 October, the Federal Government issued its long-awaited workplace relations reform. The document spans some 240-odd pages of dense legislation and if passed will represent some of the most significant employment reforms in well over a decade. Tom Earls from Fair Work Lawyers provides an initial review of the legislation for ACA members.

This is the legislation as introduced. While it is expected to pass in some form, it may be subject to amendment. The government has indicated its intention to pass this legislation before parliament rises on 1 December 2022, although that will be subject to the Senate’s views. Note that the composition of the Senate suggests a reasonable portion of the legislation will be passed.

At first glance, all employers will need to take certain steps to consider their position in light of the legislation. We have included a brief summary of those more pressing compliance issues. However, the ‘devil is in the detail’ and each business will need to carefully consider its circumstances.
