Join the ACA and builders for an open discussion to unpack the risks and rewards in the novated D&C environment.
The contractual novation of consultants from the client to a builder in a design and construct contract is becoming a common procurement method among private and, more recently, public sector clients in South Australia.
The recent spate of high profile building failures across the world, such as the Grenfell Tower fire in London, the Opal Tower structural failure in Sydney and a number of cladding fires has reduced the public’s confidence in the construction industry. The Lacrosse Tower fire in Melbourne, with its ensuing court case and subsequent findings brought down by Judge Ted Woodward, has also shone a bright light on the potential pitfalls of this form of contracting, and the way it ‘successfully’ transfers risk from client/developer to the builder and in particular to their consultant team.
The ACA has also just published a legal primer on novation from Legal Counsel Christopher Larcos to better inform architects of the risks relating to this form of contracting.
