Special Conditions for ABIC BW 2018 C
Special conditions allow the ABIC Commercial Basic Works Contract to be adapted for use on small residential projects in New South Wales.
The ACA – NSW / ACT has worked with Moray and Agnew to develop the following special conditions for the ABIC Commercial Basic Works Contract. These amend the contract to the minimum extent necessary such that it complies with the Home Building Act 1989 (NSW), thereby making it suitable for use on residential building work projects in NSW.
Once incorporated into the ABIC BW 2018 C contract, the Special Conditions will:
- amend the contract such that it complies with the Home Building Act 1989 (NSW);
- replace the stage payment structure with a monthly payment structure; and
- not otherwise amend the risk profile or operation of the contract.
You must, therefore, separately obtain a copy of the contract.
Notes
These special conditions are designed to be incorporated into Schedule 2 (Special Conditions) of the ABIC BW 2018 C Commercial Basic Works Contract for projects in NSW. They may not be used with any other form of contract, and they are not a replacement for the ABIC BW 2018 C contract.
These special conditions are not suitable for use outside NSW.
