Fair Work Information Statements

A Fair Work Information Statement must be given to all new employees, as part of an employer’s responsibilities under the National Employment Standards. Casuals must be given the Casual Employment Information Statement and fixed-term employees the Fixed Term Contract Information Statement. Read our quick summary and access relevant links below.

Fair Work Information Statement

The provision of a Fair Work Information Statement to all new employees is required under the National Employment Standards, which set out the 10 minimum employment entitlements that must be provided to all employees. You can incur hefty penalties for not supplying one.

This is easy and simple to do – download the Fair Work Information Statement and ensure that you give it to new employees before they start work (or as soon as practicable after they start).

The statement includes information on the following:

  • the National Employment Standards
  • modern awards
  • right to request flexible working arrangements
  • individual flexibility arrangements
  • termination of employment
  • making agreements under the Fair Work Act 2009
  • right of entry
  • the role of the Fair Work Ombudsman and the Fair Work Commission

The Fair Work Ombudsman also provides a fact sheet on Fair Work Information Statements.

Casual Employment Information Statement (CEIS)

Employers must also give every new casual employee a copy of the Casual Employment Information Statement (CEIS) at the same time.

The CEIS includes information about:

  • the definition of a casual employee
  • how casual employment can be changed, including when an employee can notify their employer of their intention to change to permanent employment
  • the reasons why an employer may not accept an employee’s notice
  • the role of the Fair Work Commission to deal with disputes.

Fixed Term Contract Information Statement (FTCIS)

When an employee enters a new fixed term contract, they must also be given a copy of the Fixed Term Contract Information Statement (FTCIS).

The FTCIS has information about:

  • what a fixed term contract is
  • limitations on the use of fixed term contracts
  • exceptions to the limitations
  • how to resolve disputes about fixed term contract limitations and exceptions.
