Professional Services Subcontract
The Professional Services Subcontract (updated December 2023) is available for members to use when a back-to-back agreement is required with the Lead Consultant.
The Professional Services Subcontract provides a guide for the straightforward engagement of subconsultants by the Lead Consultant. Note: this does not replace legal and insurance advice.
The development of the subcontract was led by Simon Thomson of ACA – SA, with John Held. It was developed in partnership with Minter Ellison and Planned Cover. The explanatory note was updated in December 2023 to reflect changes to the unfair contracts legislation that came into effect on 10 November 2023.
Note: Architects may wish to reformat the contract terms by changing logos, fonts, and so on. However, it is important that they retain the clause numbering and indent structure in the contract terms.
